There shall be a Public Works and Utilities Commission in the Borough of East Rutherford, which shall serve as an advisory Board to the Mayor and Council. The Commission shall have two divisions:
A. 
Division of Public Works, which shall have charge of collection and disposal of garbage and refuse, the repairing and maintaining of streets, highways and other public places and the repairing and maintaining of the storm sewerage system of the borough.
B. 
Division of Utilities, which shall have charge of the maintenance, repairing and operating of the sewerage and utility systems throughout the municipality.
The Mayor and Council shall appoint a suitable, qualified person, resident in the municipality, as Superintendent of Public Works to hold office for the term of one year, subject to certification by New Jersey Department of Civil Service, if required, who shall hold office until his successor is appointed and has qualified. He shall be a resident of the borough.

The Mayor and Council shall appoint a suitable, qualified person, resident in the municipality, as Superintendent of Utilities to hold office for the term of one year, subject to certification by New Jersey Department of Civil Service, if required, who shall hold office until his successor is appointed and has qualified. He shall be a resident of the borough.

The Mayor and Council shall appoint a Commission of Public Works and Utilities. The Commission shall consist of five voting members. The five voting members shall have initial terms of one year (one member), two years (two members) and three years (two members). Thereafter, each member shall have a term of three years from the date of appointment so as to provide for staggered terms. The Commission shall, as more fully set forth within its enabling ordinance, be directly responsible to the Mayor and Council for the operation of maintenance of the Department of Public Works and Utilities. All members of the Commission shall be residents of the Borough of East Rutherford. The Commission shall elect officers pursuant to the Commission's bylaws. The Commission shall also consist of the Mayor and a Council liaison who shall have no voting privileges, but permitted to attend all meetings (open and closed sessions pursuant to the Open Public Meetings Law[1]). The Mayor and Council liaison are present in an advisory function only.

The Commission of Public Works and Utilities shall have full responsibility and supervision over all officers and employees assigned to the Department of Public Works and Utilities, subject to the approval and control of the Mayor and Council; and shall coordinate the efforts of the Department, the Superintendent of Public Works and Superintendent of Public Utilities and all employees of the Department; and shall perform such other duties as shall be assigned them from time to time by the Mayor and Council, including but not limited to:
A. 
Have full charge, control and direction and supervision of all the duties connected with the maintenance and operation of the Department of Public Works and Utilities, including the coordination of duties of all supervisory employees of the Department of Public Works and, further, the coordination of the work of the Department with the governing body.
B. 
Have full charge, control, direction and supervision and power to direct and remove or cause to be removed all household and municipal refuse from all households and apartment buildings and such stores, offices and business places as may come within the provisions of the general ordinances of the Borough of East Rutherford.
C. 
Have full charge, control, direction and supervision over the formulation and collection schedules and methods of collection.
D. 
Have full charge, control, direction and supervision of the maintenance of records with respect to the working laws and of all labors in the Department of Public Works.
E. 
Have full charge, control, direction and supervision of the approval of the purchase of any material required by the Department.
F. 
Have full charge, control, direction and supervision of all street and sidewalk work and other public work of the borough and see that the same is properly done in accordance with the borough's ordinances and instructions of the Mayor and Council, as well as all rules from time to time by the Mayor and Council.
G. 
Have full charge, control, direction and supervision over all road equipment, trucks and materials.
H. 
Maintain contact with the Building Subcode Official and report to him on new construction, demolition or removal of private building structures.
I. 
Have all other powers necessary and incidental to fully discharge the duties of his office.
J. 
Have full charge, control, direction and supervision of all duties discharged by the Department of Public Works and Utilities.
K. 
The charging and collecting of rents, rates, fees and other charges (service charges) for the direct or indirect connection with or the use or services of the sewerage system. The intent of said charges are to be self-liquidating of the cost of the maintenance and repair of said system and in accord with such standards, rules and regulations as may be set by the Mayor and Council and Commission policies.
